G.S.V. v. Transportes Adriana, et al.

Aubrey Corwin, M.S., L.P.C., C.R.C., C.L.C.P., was retained by Defense counsel on a Santa Cruz, Arizona personal injury case to rebut the Plaintiff’s economic loss claims following a claimed “hard fall” from a semi-trailer at a loading dock. She provided both an Earning Capacity Evaluation and rebuttal opinions to Plaintiff expert’s Life Care Plan.

The Plaintiff reported ongoing low back pain but presented with no acute findings on post-incident medical imaging, which revealed only mild degenerative changes. Despite this, the Plaintiff claimed significant economic losses and included high-cost surgical estimates in a proposed Life Care Plan and also claimed significant lost wages and diminished earning capacity as a result of the alleged injury.

Ms. Corwin conducted a vocational assessment and reviewed the medical documentation. She concluded that the Plaintiff-retained expert’s earning capacity assumptions and surgical projections lacked medical support and were speculative and unreliable.

Defense counsel took these opinions to ongoing negotiations and notified us at the resolution of the case: “Can you please let Ms. Corwin know this case settled. She has been an absolute pleasure to work with and I appreciate all her help!!”
