Early Jackson v. Shea Properties Management Company, Inc., et al.

Vocational Diagnostics, Inc. was retained by the Defense in a case involving a Plaintiff who entered a Denver apartment building seeking warmth and claimed injury during an altercation with security. Defense maintained, and given all medical records from treating physicians as well as retained experts, that Plaintiff was not injured in the incident and instead his injuries were attributed to his pre-existing, degenerative conditions. The Plaintiff rejected multiple settlement offers from the Defense. Instead, he proceeded to trial with a civil rights firm, seeking $42.5 million in damages. Director of VDI, Aubrey Corwin, M.S., L.P.C., C.R.C., C.L.C.P., provided an Assessment of Future Care Needs and testified at trial, offering key insights that informed the Defense strategy and effectively addressed the claimed damages. The trial focused on medical evidence and damages, given the liability issues. The jurors essentially discarded the Plaintiff expert’s Life Care Plan in which he stated that the Plaintiff would require $4 million in future care and awarded a total verdict of $1,025,000, less than $300,000 of which was for economic damages. Since the verdict was less than the statutory offer and accounted for Plaintiff’s comparative negligence, he was left with little to no financial recovery after expenses. This outcome underscores the importance of expert analysis and testimony in minimizing financial exposure and achieving a fair resolution.
